Protection of intellectual property rights in the Internet (including domain names disputes)

The development of the Internet and its use with information, advertising, commercial and other similar purposes result in frequent breach of intellectual property rights, for example, illegal advertising of good without agreement with the owner of the right, illegal exploitation of trademark with the purpose of obtaining commercial profit, showing of work of other author without his permission, and other breaches.

The prevalent breach is illegal exploitation of domain names, for example, if domain name copies the registered trademark or firm-name.

At present time, in the legislation of Ukraine, there is no direct regulation of the right for use of objects of intellectual property in the Internet.

But, for example, during registration of domain name in .UA zone there is the rule, according to which before the registration, the registrant must provide documents which confirm the rights for trademark, identical with the domain to be registered.

By using national legislation legally correctly, it is possible to ground your rights and to prevent the breach of right using the Internet.
