Registration of objects of intellectual property in customs service of Ukraine

Recently, the custom-houses have more and more requests from the subjects of foreign-economic activity that move goods containing objects of intellectual property through customs boundary of Ukraine.

With the purpose of prevention of breaching the intellectual property rights during import or export, it is very important for the owner of objects of intellectual property to establish control of moving them through customs boundary of Ukraine.

State customs service of Ukraine has the right to establish such control of moving goods containing objects of intellectual property on condition that present goods are registered.

The registration is carried out for a period of six months or one year.

To perform this, it is necessary to file to state customs service of Ukraine the necessary documents of set form with comprehensive data about good which allow to identify a registered good and to different it from infringing production.

Just the owner of industrial rights or copyrights responds for assuming the measures for protecting his rights and decides whether it is necessary to provide such measures on the custom-house.

In case of presence of sufficient causes to consider that registered object of intellectual property moves through the boundary of Ukraine with breach of intellectual property rights of the owner of such object, the owner or his representative can apply to customs service with motivated request about discontinuance of customs execution of an object of intellectual property.
