Registration in Ukraine of copyrights and related rights

The legislation of Ukraine protects private non-property and property rights of authors and their assignees incidental with creation and use of science, literature and art writings (copyright), as well as rights of executors of phonogrammes and videogrammes and broadcasting organizations (related rights).

The copyright proprietors are authors of writings, their descendants and persons to whom property copyrights were granted by authors or their descendants.

The copyrights among others are:

- pleadings, lections, speeches, sermons and other verbal writings;

- computer programs;

- databases;

- audio-visual writings;

- translation texts for duplication, soundtracking, subtitling in Ukrainian and other languages of foreign audio-visual writings.

The copyright acts during the whole life of an author and 70 years after his death, save some exceptional cases.

The related rights proprietors are:

- executors of writings;

- makers of phonogrammes and videogrammes;

- broadcasting organizations,

- descendants or assignees of above proprietors.

The objects of related rights are:

- executors of literary, dramatical, musical and other writings;

- phonogrammes, videogrammes;

- broadcasts (programmes) of broadcasting organizations.

Period of validity of related rights:

- property rights of executors are protected during 50 years from the date of first recording of writing; private non-property of executors are protected perpetuitly;

- the rights of makers of phonogrammes and videogrammes, as well as broadcasting organizations are protected during 50 years from the date of first public issuance or announcement.
