Patenting in Ukraine of designs

Under the legislation of Ukraine a design is a result of creative action of a person in the field of artistic design.

The object of design may include shape, picture or coloring or a combination thereof which define appearance of a product of industry and are assigned for satisfying of esthetic and ergonomic wants.

A property right for design is ascertained by patent which assures priority, authorship and sole right for use thereof.

The period of validity of patent for design is 10 years from the filing date to the Patent Office and is prolonged by the Office under the request of the owner of patent but not longer than for 5 years.

An extent of protection of patent for design is defined by a complex of its dominant features represented in photographs of a product (its bread board and/or depiction).

The rights incidental from the patent act from the date of publication of information about its grant provided the annual due fees for patent maintenance are paid.
