Patenting in Ukraine of inventions (utility models)

Under the legislation of Ukraine the objects of invention (utility model) may include:

- a product (device, substance, culture of microorganism, culture of cells of plants and animals, etc.);

- a method;

- use of previously known product or method for new purpose.

Patent for invention (utility model) ascertains property right, priority and right of authorship of person who created an invention.

The rights incidental from the patent act from the date of publication of information about its grant provided the due fees for patent maintenance are paid.

Period of validity of patent:

- for invention - 20 years from the filing date;

- for utility model - 10 years from the filing date.

Any person has a right to patent an invention (utility model) in foreign states.
